Terms of service

These terms are the agreement between you and Dzmitry Papkou (private individual / fizinis asmuo), Vilnius, Lithuania (“we”, “us”) for your use of wspell. You accept them when you create an account. Our full details are on the Imprint & contact page.

Please read the section on exam results — it matters more than the rest.

The free public beta

wspell is in a free public beta. Nothing is for sale: every feature open to you is free, no payment is taken, and mock-exam sittings are not counted against any allowance.

Paid plans and one-time purchases are built and will return. The sections about them below apply only once they are open again. Before that happens we will update these terms and their date, and nothing is ever charged without you completing a checkout.

Your account

You need an account for most of wspell. Give accurate details, keep your password to yourself, and tell us promptly if someone else gets into your account.

You must be 16 or older to create an account, and you confirm this when you sign up.

One account is for one person. An account can be signed in on 3 devices at a time: signing in on a fourth asks you to sign one of the others out first. You can see and sign out your devices in Settings.

Paid plans

Some features need a paid plan (student, pro or tutor), billed monthly or yearly. Prices are shown before you buy, in euros, and the amount shown at checkout is the full amount charged — nothing is added to it. Stripe takes the payment; in the iOS app, Apple does.

Each exam you prepare for takes a place, and a course you study with no exam takes one; a passed exam takes none. Free holds 3 places; student, pro, tutor and the exam pass hold 5. Recording a pass frees its place at once. Leaving a course or an exam frees its place after 7 days, or at once within a day of taking it; pausing frees nothing. If you hold more than your plan allows (for example, after a paid plan ends), nothing is removed: adding waits until you are under the limit.

A plan renews automatically at the end of each period, every month or every year, until you cancel. Cancel at any time: you keep access until the end of the period you have paid for, and you are not charged again.

The exam pass is a single payment for one exam, not a plan: it gives the student plan's energy tank, practice tickets and monthly gold until the date you set for that exam, and for six months at most. It does not renew, and it is sold only to an account below the student plan.

A plan bought in the iOS app is billed by Apple: cancel it in your Apple subscription settings — deleting your wspell account does not stop Apple’s billing.

Changing to another plan takes effect at once: a dearer plan charges the prorated difference to the card on file immediately, a cheaper one credits the difference against your future invoices, and if the card is declined, nothing changes.

When you move to a cheaper plan, the difference is credited to your balance with our payment processor and taken off your future invoices. It is a credit, not a refund, and it is not paid out if you later cancel.

We may change prices for future periods. We will tell you before a new price applies to you, and you can cancel before it does.

Mock-exam sittings, wallets and purchases

A full mock exam is a sitting. A sitting is charged when it starts, not when you submit it — the way a real exam is — so a paper you leave unfinished still counts. Starting it over within two minutes, before answering anything, does not cost a second one.

You can have one sitting running at a time, and it belongs to the device you started it on. It can be moved to another device once.

Each plan includes a monthly allowance of sittings: 1 on the free plan, 5 on student, unlimited on pro and tutor. AI features, where your plan includes them, use a separate monthly allowance of AI credits. Allowances refill at the start of each calendar month; an unused allowance does not carry over.

Sittings and AI credits are two separate wallets, and one never pays for the other. You can buy more of either as a one-time pack. Bought sittings and credits do not expire, are used only after the monthly allowance, and stay with your account if you cancel a plan. They are not money: apart from the right of withdrawal below, they cannot be exchanged back for money, and they are deleted with your account.

Skins — cosmetic looks for your fox — are one-time purchases that stay with your account for as long as it exists.

Gold, energy and game items. Studying pays up to 100 gold a day, and one-off rewards — a checkpoint, a camp, a chest, the bonus roll — come on top of that; all the gold earned in a day stops at 200, with an exam passed and the week's quest chests on top of it. Your energy is a tank, full every morning: 20 on the free plan, 40 on student and with the exam pass, 80 on pro and tutor. Every tile you walk on the practice map takes from it — 2 for a tile of your own land, 10 for a step onto new ground — and a lesson passed gives 2 back, your daily goal 6, never past the tank. Steps onto new ground that the tank cannot cover cost gold, and a day takes six such steps at most. Once a day you can refill the tank for 150 gold, and for 300 gold you can keep one more exam active for 30 days. You can buy gold, a full energy tank, practice tickets and other game items — paladins, a streak relight, a second wind in a castle run, an extra mock exam, portals and looks — each as a one-time purchase at the price shown before you buy. Bought gold is kept apart from earned gold and is spent first. Gold, energy, tickets and items are not money: apart from the right of withdrawal below, they cannot be exchanged back for money, and they are deleted with your account. If something you paid for can no longer be delivered when your payment arrives — the day's full tank was already bought, or the tank is already full, for example — we refund the payment in full. Game purchases are limited to €50 in a calendar month.

Your right of withdrawal

If you are a consumer, you may withdraw from a purchase within 14 days of making it, without giving a reason. To withdraw, send us a clear statement before the 14 days are over — an email to support@wspell.com is enough; there is no form to fill in. We refund what you are owed within 14 days of receiving your statement, to the payment method you used.

Plans, the exam pass, packs, gold and the other game items except looks are digital services. At checkout you expressly ask for one to start straight away, and acknowledge that if you withdraw you pay for what you have used. You keep the right of withdrawal: if you withdraw within the 14 days, you pay only for what you have used — for a plan or the exam pass, the part of the period until you withdrew; for a pack, the sittings already started or the AI credits already spent; for gold, tickets or a full energy tank, what you have already spent; a streak relight and a second wind are used in full the moment they are given — and we refund the rest. The right ends only once the service has been provided in full: for example when every sitting in a pack has been used, or, for a streak relight or a second wind, the moment it is given, as you acknowledge at its checkout.

Skins, portals and looks are digital content supplied immediately. If at checkout you expressly ask for one to be supplied at once and acknowledge that you lose the right of withdrawal, the right ends when it is delivered. Without that consent the right applies in full.

A plan bought in the iOS app is sold through Apple: withdraw from it and get your refund through Apple at https://reportaproblem.apple.com.

If you want, copy this into your email and fill in the brackets:

  • To: Dzmitry Papkou (private individual / fizinis asmuo), Vilnius, Lithuania, support@wspell.com
  • I hereby give notice that I withdraw from my contract for the following service or digital content: [plan, exam pass, pack, game item or look]
  • Ordered on: [date]
  • Name and email address of the account: [name, email]
  • Date: [today’s date]

After each purchase we email you an order confirmation with our details, the price, the billing period where there is one, your withdrawal terms and a link to these terms.

Ending the agreement

You can stop using wspell and delete your account at any time in Settings. Deleting it cancels an active plan immediately (except a plan bought through Apple, which you cancel with Apple — see above): the rest of the paid period, an exam pass and any bought sittings, credits, gold, tickets, skins and looks are lost, and nothing is refunded — apart from a withdrawal you make within the 14 days above. The app warns you about this before you confirm.

We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law or the security of the service requires it. Where it is reasonable we warn you first, and we tell you the reason.

We do not refund automatically. If we end a paid plan when you are not at fault, write to us at support@wspell.com: your rights under consumer law apply in full.

No guarantee of exam results

wspell is study material, not an exam authority. Exam names and trade marks that appear on wspell belong to the organisations that own and run those exams, and are used only to say which exam a course prepares for. We are not affiliated with, endorsed by or acting for any exam provider, examination board or government body.

We work hard to make our content accurate and close to the real exams, but we cannot promise it is complete or current, or that it matches what an exam will ask. The fees, dates and requirements in our exam guides are summaries and can change; a guide checked against official sources shows the date it was checked. Using wspell does not guarantee that you will pass anything. Your result is yours.

Always check the official requirements for your exam with the body that runs it.

Acceptable use

Use wspell for learning. Do not:

  • break the law, or use the service to harm, harass or impersonate anyone;
  • copy, scrape, bulk-download or resell our content, datasets or exam material;
  • try to break, overload, probe or get around the service’s security or its access and payment controls;
  • upload content you have no right to use, or anything unlawful or abusive;
  • use automated means to create accounts or extract data.

The service limits how many requests it accepts per minute, and per day for some look-ups; a request over a limit is refused until the limit resets.

We may suspend or close an account that breaks these rules. Where it is reasonable to do so, we will warn you first.

Your content

Anything you create — your word sets, notes, decks and exams — stays yours.

To run the service we need your permission to store your content and show it back to you. If you publish something, you also let us and other learners view and study it, and that permission continues for published content after you delete your account (your name is removed from it). Keep a copy of anything you would be sorry to lose.

You are responsible for what you upload. The next section says what may not be published, and what happens when something is.

Published sets

A set you publish — make public in the library, or share by link — is shown to other people. A person reviews a public set before anyone else can see it, and again after you change it. A set shared by link is not reviewed first, but the same rules apply to it.

Do not publish:

  • anything illegal;
  • material you have no right to share — copied from a textbook, an exam paper, a dictionary or anyone else’s work without permission;
  • personal data about another person, such as their name with contact details or private facts about them;
  • harassment, threats, hate, or anything that demeans a person or a group;
  • advertising, spam, or anything that has nothing to do with learning.

If a set breaks these rules or the law, we may refuse to publish it or take it out of view — either way it stays in your account, visible only to you, its share links stop working, and it cannot be shared until it has passed review; changing it or making it public puts it in front of a reviewer — or delete it. We act on reports (see the next section) and on our own review.

A person takes every decision on a published set and on every report. One check is automatic, and it runs before anything is saved: a set that contains words or questions from our paid exam material is refused when you save it, whoever it is for.

When we restrict a set of yours, we email you a statement of reasons: what we decided, the facts it rests on, whether a report led to it, and the clause of these terms or the law it is based on. The statement does not say who reported the set.

If you disagree, reply to that email or write to support@wspell.com, and a person looks at the decision again and tells you the result. We have no separate complaints procedure. You can also take the matter to a court.

Reporting content

Anyone can report content on wspell that is illegal or breaks these terms, with or without an account. Every set someone else made has a Report this set link — in its preview in the set library, and on the page a share link opens. It asks what the problem is and why, and for your confirmation that the report is accurate; without an account you may leave an email address so that we can answer you.

For anything else, or if you prefer, email support@wspell.com with a link to the content and the reason.

We confirm by email that the report arrived, when we have your address; an address left without an account is emailed about at most three reports a day. A person reviews and decides every report. We decide without undue delay and email you the outcome and our reasons. If you disagree, reply to that email and a person looks at it again; there is no separate complaints procedure, and you can also take the matter to a court.

Our content

The service, its software, design and exercises, and the datasets behind them belong to us or our licensors. You get a personal, non-transferable licence to use them for your own study, and nothing more. The Imprint & contact page credits the open-licensed voices, word meanings and fonts we use.

One exception: the grammar chart pictures (the images under wspell.com/charts, shown on the grammar chart pages) are licensed under Creative Commons Attribution 4.0 (CC BY 4.0). You may share and adapt them, commercially too, as long as you credit wspell and link to the chart's page: https://creativecommons.org/licenses/by/4.0/

Availability and changes

We aim to keep wspell running well, but we do not promise uninterrupted service. We may need downtime for maintenance, and things occasionally break.

We may add, change or withdraw features. If we withdraw something significant that you are paying for, you may cancel.

Some features are experimental and visible only to our own team while being built.

AI features

Some features generate text automatically with an AI model: the writing and speaking reviews, the AI tutor and the coach, grammar explanations, and generated sentences and questions. What you submit to them is sent to our AI provider to be processed (see the privacy policy).

Their answers can be wrong, including confidently wrong. A score or level from an AI review is a study estimate, not an official assessment or a prediction of an exam result. Check anything important, particularly about exam rules.

A review of a written or spoken answer is made after you send it, not at once: it comes back within 7 days in practice and within 3 days in a mock exam, and a mock exam with such parts shows its full result when their reviews are in. If no review comes back in that time, the answer is not marked and any AI credits it cost are given back.

Liability

Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud.

Otherwise, and to the extent the law allows: the service is provided as it is; we are not liable for indirect or consequential loss, lost profits, lost data, or an exam result; and our total liability to you is limited to the greater of what you paid us in the twelve months before the claim and EUR 100.

As a consumer you also have the legal guarantee of conformity: what we supply must work as described, and if it does not, you can ask us to put it right or, failing that, for a price reduction or a refund.

If you use wspell as a consumer, your statutory rights are unaffected.

Changes to these terms

We may update these terms. We update the date at the top of this page, and a significant change applies to you only after we have told you about it — by email or in the app — and you have had the chance to delete your account before it takes effect.

Governing law and disputes

These terms are governed by the law of the Republic of Lithuania. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a claim in its courts as well as in Lithuania’s.

If we cannot settle a complaint between us, you can take it, out of court, to the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba), A. Goštauto g. 12, LT-01108 Vilnius, https://vvtat.lrv.lt. The EU’s online dispute resolution platform has closed, so it is no longer a route.

A contract with us can be concluded in: English, Russian. Contact: support@wspell.com.

These terms are also published in Russian. The English text is the original: if a translation differs from it, the English text prevails.
